Terms of Use

These terms apply to DrumTick (“the app”), published by Phan Trung Kien (“we”, “us”). By downloading or using the app you agree to them. If you do not, please do not use the app.
1. Licence
We grant you a personal, non-transferable, non-exclusive licence to use DrumTick on Apple devices that you own or control, in line with the Apple Media Services Terms and Conditions. You may not copy, sell, sublicense, reverse-engineer or redistribute the app or its sound and image assets.
2. DrumTick Pro subscription
The app is free to download and includes a complete metronome. DrumTick Pro is an optional auto-renewing subscription that unlocks all sound sets, unlimited presets and custom routine editing.
Auto-renewal. Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically at the same price for the same period unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
Cancelling. You can manage or cancel the subscription at any time in Settings → your name → Subscriptions on your device. Cancelling stops the next renewal; it does not shorten the period you have already paid for.
Prices are shown in your local currency inside the app before you confirm, and may differ by region. If a price changes, Apple notifies you and asks for consent before the next renewal at the new price.
3. What happens if Pro lapses
Nothing you made is deleted. If a subscription ends, Pro sound sets fall back to the free default, and presets beyond the free allowance stop being loadable — but they stay on your device and become available again the moment Pro is active again. Routines you wrote yourself remain editable. We do not hold your own work hostage to a lapsed subscription.
4. Refunds
All purchases go through Apple, so refunds are handled by Apple and not by us. Request one at reportaproblem.apple.com. We have no ability to issue, approve or deny a refund on your behalf.
5. Acceptable use
Use the app for practising and performing music. Do not use it to break the law, and do not attempt to bypass the purchase system or extract the bundled audio and artwork for use elsewhere.
6. Hearing and safety
DrumTick produces sound and can flash the screen on every beat. Protect your hearing: loud playback through headphones over long sessions can damage it. If you are sensitive to flashing light, leave Flash Screen off — it is off by default, and the app disables it automatically when Reduce Motion is on in iOS. Take breaks; practice is a physical activity and overuse injuries are real.
7. No warranty
The app is provided “as is”. We work hard on timing accuracy, but we cannot guarantee the app is free of defects or that it will be uninterrupted on every device and every iOS version. To the fullest extent permitted by law, we disclaim all implied warranties.
8. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim relating to the app is limited to the amount you paid for it in the twelve months before the claim arose. We are not liable for indirect or consequential loss, including missed performances or lost practice data.
9. Apple
Apple is not a party to these terms and has no responsibility for the app. Apple is, however, a third-party beneficiary of these terms and may enforce them against you. Any claim about the app being defective is between you and us, not Apple — although Apple may refund the purchase price under its own policies.
10. Changes
We may update these terms when the app changes. The date at the top always reflects the current version. Continuing to use the app after an update means you accept the revised terms.
